Upselling selected product is shown again during checkout process

I have a list of regular products and subscriptions added to smithcart. New install, dnn 6.2.2. IIS 7.
I'm "upselling" the subscription products so that they are shown during check out if a regular product is selected.
Fining that if an "upsold" product is selected for purchase it is shown again during the checkout process. Is there any way to exlude a product if it is already added to the cart. Or for that matter exlude a "group" of products. (inferring that there is some type of 'group' type to do this in the first place)

Which version of the Cart are you currently running?

Does your "Upsell" Product have any variants configured?

running 5.0.
No. variants are not configured in the upsold product.
They are configured for some of the other products.. but not the current product being upsold

To clarify, are you requesting that if a Product which has been enabled to "Upsell" is added to the Cart, that you do not want it to be displayed on the Upsell page after proceeding to Checkout?
